Pacemark is a Dan Cumberland Labs project. By accessing pacemark.ai or using the Pacemark Signal Scorer, you agree to these terms. If you do not agree, please do not use the site.

Purpose of Pacemark

Pacemark provides an educational AI maturity assessment and related information for business leaders. The result is a directional self-assessment based on your responses. It does not replace professional, legal, security, financial, engineering, or other specialist advice.

Acceptable use

You may use Pacemark for lawful business evaluation. You may not interfere with the site, attempt unauthorized access, introduce harmful code, use automated means to extract material from the site without permission, or use Pacemark in a way that infringes another person’s rights.

Results and decisions

You are responsible for the information you enter and for decisions made using a Pacemark result. We do not promise that the assessment, its recommendations, or any related service will produce a specific business, revenue, time-saving, or operational outcome.

Intellectual property

Pacemark’s content, assessment, methodology, software, design, text, graphics, and marks are owned by or licensed to Dan Cumberland Labs and protected by applicable intellectual-property laws. You may use your own result internally. You may not reproduce, sell, publish, modify, or create derivative works from Pacemark materials without written permission.

Third-party services and links

Pacemark may link to third-party services, including scheduling and email services. Those services are governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices.

Paid engagements

Any consulting, coaching, workshop, or other paid work with Dan Cumberland Labs is governed by the separate agreement for that engagement. That agreement controls if it conflicts with these website terms.

Disclaimers and liability

Pacemark is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Dan Cumberland Labs disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of Pacemark.

Indemnity and governing law

You agree to indemnify and hold harmless Dan Cumberland Labs, its owner, employees, and agents from claims, damages, losses, or expenses arising from your use of Pacemark or your violation of these terms. These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules.

Changes and contact
